By using the Xpend platform, you agree to these Terms of Service ("Terms"), which form a binding agreement between you and JustXpend Technologies a subsidiary of Seniore Ltd.

About Xpend

Xpend is an AI-powered cryptocurrency spending assistant accessible via WhatsApp, designed to help users in Nigeria manage their crypto finances. Features include depositing USDT, transferring funds to local bank accounts, tracking balances, and receiving real-time exchange rates through chat commands. This service is provided by JustXpend Technologies.

Eligibility

To use Xpend, you must:

  • Be at least 18 years old.
  • Own the WhatsApp number linked to your account.
  • Have legal authority to use connected payment methods or crypto wallets.
  • Reside in Nigeria or be authorized to perform financial transactions there.

Acceptable Use

You agree to use Xpend only for legitimate personal financial purposes and to provide accurate details, including a valid Bank Verification Number (BVN) and bank information. Prohibited activities include fraud, money laundering, impersonation, or attempting to manipulate exchange rates or system vulnerabilities. We may suspend or terminate your access for any violation.

Data Handling

Your use of Xpend is governed by our Privacy Policy, which explains how we collect, store, and process your personal and financial data. By using the service, you consent to this data handling as outlined.

KYC Verification & Third-Party Processing

To comply with applicable laws and platform risk controls, we may require identity verification ("KYC"). For Basic KYC we use Smile Identity, a third‑party provider. By starting KYC you authorize us to share the minimum necessary data (e.g., name, date of birth, gender, country, phone and ID number) with Smile Identity for verification and to receive verification results (e.g., pass/partial/no‑match, metadata and receipts). Smile Identity processes this information in accordance with its own terms and policies. We use the results solely to determine your Xpend KYC level and applicable limits.

Data Retention

We retain your data for the following periods:

  • Account Information: Name, phone, BVN, bank details retained for 7 years after account closure to comply with anti-money laundering (AML) and financial regulations
  • KYC and Transaction Data: Retained for 7 years in line with regulatory requirements
  • Chat Messages and Bot Interactions: Retained for up to 12 months, unless earlier deletion is requested
  • Anonymized Data: Used for analytics or AI model training, retained indefinitely without personally identifiable markers

You may request data deletion at any time, subject to legal retention requirements.

Service Limitations

Xpend offers AI-assisted financial tools, not professional advice. Accuracy of responses or exchange rates cannot be guaranteed due to market fluctuations or AI limitations. We may restrict access or features for maintenance or regulatory compliance.

Transaction Responsibilities

You are responsible for verifying all transaction details before confirmation, as they may be irreversible. JustXpend Technologies is not liable for errors from incorrect inputs, third-party delays, exchange rate changes, or network issues.

Transaction Limits

Transfer limits depend on your KYC level and may change based on regulatory guidance and risk controls. Completing KYC may increase your daily and per‑transaction limits. Current limits are displayed in the app/bot and may be updated from time to time.

KYC Outcomes and Appeals

If your KYC is approved, your limits will be upgraded automatically. If your KYC is not approved, we will notify you and you may re‑attempt verification with corrected details or a different ID type where available. We reserve the right to request re‑verification at any time.

Intellectual Property

All elements of the Xpend platform, including its branding and AI technology, are owned by JustXpend Technologies and its partners. Unauthorized copying, modification, or reverse-engineering is prohibited.

Termination

You may discontinue use by contacting support@justxpend.ai. We may terminate or suspend your access for breaches, legal requirements, or security concerns.

Changes to Terms

We may update these Terms as needed, with notifications sent via WhatsApp or email. Continued use after updates indicates your acceptance.

Dispute Resolution

Any disputes arising from your use of Xpend will be addressed as follows:

  • Informal Resolution: You agree to first attempt to resolve issues by contacting us at support@justxpend.ai within 30 days of the dispute's occurrence.
  • Mediation: If unresolved, both parties may agree to mediation by a neutral third party in Nigeria.
  • Governing Law: These Terms are governed by the laws of the Federal Republic of Nigeria. Any legal action will be subject to the exclusive jurisdiction of courts within Nigeria.
  • Limitation: You waive the right to participate in a class action lawsuit against JustXpend Technologies.

Refund Policies

Xpend operates on a non-refundable transaction basis due to the irreversible nature of cryptocurrency and bank transfers. However:

  • Error Claims: If a transaction error occurs due to our system (e.g., incorrect processing), you may request a review by contacting support@justxpend.ai within 7 days, providing transaction details. We will investigate and, at our discretion, offer a credit or resolution.
  • No Guarantees: Refunds are not available for losses due to market fluctuations, user errors, or third-party delays.
  • Exceptions: Any refund or credit decision is final and at our sole discretion, subject to applicable laws.
